Terms and Conditions of Sale

Welcome to Zepski. These Terms form a binding agreement between you and Kyle Christopher Rzepski, the operator of zepski.com, and apply to all visits and purchases. Our Return and Refund Policy, Shipping Policy and Privacy Policy are part of these Terms. Your use of the Site or completion of an order constitutes acceptance.

Who May Use the Site

You must be at least 18 years old, or the age of majority in your state, to make a purchase. The Site is not directed to children under 13 and we do not knowingly collect personal information from them; if we learn that we have, we delete it. By ordering you represent that you are legally capable of entering into a binding contract and that the payment method you use is yours or you are authorized to use it.

Delivery

We ship to the United States. Orders are processed within 1–2 business days; at checkout you choose Economy Shipping (USD 11.94, 9–16 business days, free on orders of USD 119 or more) or Fast Shipping (USD 21.95, 8–13 business days). Every order includes tracking. If we cannot ship within the promised time we notify you before that date with a revised date and the right to cancel for a full refund; if the delay exceeds 30 days or is indefinite, the order is cancelled and refunded unless you expressly agree to wait. Prices and Taxes

Prices are quoted in USD and can change without notice, but the price you see when you order is the price you pay. Applicable taxes (calculated at checkout based on the shipping address) and any shipping charge appear at checkout before payment, so the final total is always visible before you commit. Promotional "was" prices are genuine prior prices. Should an obvious pricing mistake occur, we are not obliged to sell at the wrong price: we will tell you and let you decide whether to proceed.

Payment Methods and Billing

We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. Payments are processed securely by Shopify Payments (powered by Stripe); we do not store full card numbers on our servers. Your card is charged when the order is placed. The charge appears on your statement as ZEPSKI.COM. If a charge is declined, or our payment provider's fraud screening flags the order, we may ask you for additional verification or cancel the order. If you believe a charge is incorrect, please contact us before contacting your bank — most issues are resolved within a business day.

Returns and Cancellation

Our cancellation and refund terms, in summary: cancel at no cost before the order ships; return eligible items within 90 days of delivery, unused and in original packaging, to 3501 Woodhaven Road, Apt 834, Philadelphia, PA 19154, United States; return postage is free; refunds go back to the original payment method 5–10 business days after we receive and inspect the item (7 business days for cancellations); faulty or wrong items are always replaced or refunded free of charge. The full Return and Refund Policy, which you accept at checkout, governs in case of any difference.

Placing an Order

Your order is an offer to buy. After checkout you receive an order confirmation email; this acknowledges receipt of your order but does not accept it. A contract of sale is formed when we ship the goods and send the shipping confirmation. We may decline or cancel an order before shipment for reasons including unavailability, a pricing or description error, suspected fraud, or a shipping address we cannot serve; if we do, any payment is refunded in full within 7 business days. We may limit quantities per order or per customer.

Products and Availability

We make every effort to describe products accurately and to show them as they are. Colors may vary slightly with your screen settings, and dimensions are approximate unless stated as exact. Our products are unbranded, generic items sourced from selected manufacturers; any brand names appearing in descriptions are for compatibility reference only and do not indicate affiliation. Product availability is not guaranteed until an order ships; if an item becomes unavailable we contact you with the options of waiting, a substitute or a full refund. We do not use false scarcity or countdown claims.

Warranty

We provide the limited warranty set out in our Return and Refund Policy. Except for that warranty, and to the fullest extent the law allows, we make no other express warranties, and implied warranties of merchantability and fitness for a particular purpose are limited to the duration of the limited warranty. Some states do not allow such limitations, so they may not apply to you; this warranty gives you specific legal rights and you may have others that vary by state. Consistent with the Magnuson-Moss Warranty Act, nothing in these Terms disclaims implied warranties while a written warranty is in effect.

Liability

Our responsibility to you for any order is capped at the price you paid for it, and we are not responsible for indirect or consequential losses — such as lost profits or lost data — to the extent the law lets us exclude them. Nothing in these Terms limits liability for personal injury or death caused by our negligence, for fraud or fraudulent misrepresentation, or any liability that consumer protection law does not allow us to limit. Where your state or country does not permit some of these exclusions, they apply to you only as far as the law allows.

Content Ownership

The Site and everything on it, including the Zepski name and logo, images, copy and design, belong to us or our licensors. You receive a limited, revocable license to use the Site to shop; no other rights are granted. Copying our content for commercial use, scraping the Site or reusing our images requires our written consent. Notices of alleged infringement should be sent to contact@zepski.com.

Acceptable Use and Reviews

Use the Site lawfully and in good faith: no fraudulent or unauthorized orders, no attempts to breach security, no automated scraping, no abuse of discounts. Reviews on our product pages come from customers who bought the product; we take reasonable steps to verify them and never commission fake reviews. Content you submit must be truthful and yours; you allow us to publish it and we may remove anything inappropriate.

Other Terms

We may update these Terms from time to time; the version in force when you place an order applies to that order, and the current version is always available on the Site with its "last updated" date. If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site and your purchases. You may not assign your rights under these Terms; we may assign ours to a successor of the business.

Governing Law and Dispute Resolution

These Terms and any purchase are governed by the laws of the State of Pennsylvania and applicable U.S. federal law, without regard to conflict-of-law rules, and by the Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 P.S. § 201-1 et seq. where it applies. Please contact us first at contact@zepski.com: almost every issue is resolved by our support team within a few days. Arbitration agreement. If a dispute cannot be resolved informally within 30 days, you and we agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules, rather than in court, except that either party may bring an individual claim in small claims court. Class action waiver: claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase. This section is governed by the Federal Arbitration Act. Nothing in this section prevents you from filing a complaint with the consumer protection office of your state attorney general or with the Federal Trade Commission.
